HIGH DENSITY RESIDENTIAL DISTRICT (R-4)

SECTION 1000 - PURPOSE OF THIS DISTRICT

The Purpose of these districts is to provide areas for the development of higher density multiple family (i.e., three or more) residential uses with adequate, usable open space to prevent overcrowding. It is the intent of this Ordinance that these districts be carefully located only in areas where the infrastructure of the County (i.e., the street/highway system and water and sewer systems) is adequate to serve such higher density housing. The use of this district is appropriate as a transition between low or medium density residential districts and higher intensity uses, such as commercial uses or limited industrial (I-1) uses, that are not compatible with lower density residential environment. High Density Residential districts (R-4) shall only be located adjacent to streets/highways that are classified as Principal Arterial on the adopted Thoroughfares Plan.

SECTION 1001 - LAND USES PERMITTED

The following uses are permitted outright in R-4 districts subject to the regulations prescribed herein.

(a) Multiple family dwellings including apartments and condominiums as defined in Article II.

(b) Accessory uses or structures in multiple family residential complexes, including Laundromats, vending machine centers, recreational building, swimming pools, tennis courts, and similar uses and structures incidental to multiple family buildings. Such uses and structures shall be reserved exclusively for use by residents and guests of residents of the multiple family complex.

(c) Home occupations in compliance with Section 416 of this Ordinance.

SECTION 1002 - CONDITIONAL USES AND STRUCTURES AS PROVIDED IN SECTION 2406

(a) Public or quasi-public facilities an utilities in compliance with Section 414 and other regulations of this Ordinance.

(b) Child Care Facilities

SECTION 1003 - DIMENSIONAL REQUIREMENTS FOR ALL MULTIPLE FAMILY USES

1003.01 Maximum Height: 35 feet unless greater height is specifically approved by the President and Board of Supervisors at the time the site plan is approved.

1003.02 Minimum Lot Area: One (1) acre.

1003.03 Maximum Density: One multiple family unit shall allowed for each 2,500 square feet of gross site area (i.e., 17.4 units per acre).

1003.04 Minimum Lot Width: 100 feet at the building setback line.

1003.05 Minimum Yards:

(a) Front yard: 25 feet from the existing or proposed right-of-way line a shown on the adopted Hinds County Thoroughfares Plan. This yard shall be a landscaped open area with no encroachments permitted including parking lots, patios or swimming pools, or other paved areas except for entrance/exit driveways.

(b) Side yards: 10 feet from each side lot line to any building, except where a side lot line abuts an existing single-family detached residence or R-1, R-2, or R-2-M district in which case the side yard shall be 20 feet from any building to the lot line abutting the single-family detached residence or district.

(c) Rear yard: 20 feet from the rear lot line to any building.

This yard shall be a landscaped open area with no encroachments permitted including driveways, parking lots, patios or swimming pools, or other paved areas.

1003.06 Internal Building Space: No principal building or accessory building shall be constructed nearer than twenty (20) feet to any other principal building or accessory building.

SECTION 1004- REQUIRED PLANTING SCREEN FOR MULTIPLE FAMILY RESIDENTIAL USES ABUTTING EXISTING SINGLE FAMILY DETACHED RESIDENCES R-1 OR R-2 ZONES

Wherever a proposed multiple family residential use will abut an existing single family detached residence or a R-1 Low Density Residential District, or R-2 or R-2-M Medium Density Residential District the developer of the apartment or condominium complex shall install a planting screen having a height of at least six (6) feet along the side and/or rear property lines of the proposed multiple family use. The location and type of planting screen to be installed shall be noted on the site plan. Maintenance of this required planting screen shall be the responsibility of the property owner, and failure to maintain the plantings screen in a satisfactory manner shall constitute a violation of this Ordinance and be subject to the penalties prescribed herein.

SECTION 1005 - REQUIREMENTS FOR OFF-STREET PARKING, LOADING AND ACCESS CONTROL

For reasons of fire safety all proposed apartment or condominium complexes in excess of 5 acres shall provide at least two separate points of ingress/egress to/from the complex. Spacing requirements for these access points are provided under Article XXI. Developers of any proposed apartment or condominium complex or permitted special exception shall comply with parking and loading requirements included under Article XXI.

SECTION 1007 - REQUIREMENTS REGARDING EXISTING NARROW STREETS, UNPAVED STREETS AND PROPOSED NEW STREETS

The developer of any multiple family residential use in an R-4 district shall comply with the provisions of Sections 425, 426 and 427 of this Ordinance.
